i ordered some parts from AGENT SMITH a few weeks ago. he said they were shipped last week and still no sign. he will not answer pm's, emails, or even phone calls. i'm not the only person who he seems to have duped either. he made false claims that conflicted with themselves... things like, "i'm wating on yoru money... got the stuff all boxed up and ready to go!" but then when the money gets there "i'll get this boxed up soon and mail it out when it's ready." he also made claims to myself and lanos2001 that he would give us tracking numbers for our orders because he shipped them. we have yet to see a part or a tracking number.
i unfortunately felt this was something everyone on the board should know. if my merchandise and nick's shows up then i will formally appologize and delete the post.
also, the reason i'm making a big deal from this is that i paid $100 for the stuff i'm supposed to be receiving... a large chunk of money

yeah what kenny said. he told me as well that he received the package back b/c of bad handwriting on the address. they would not have taken the package if they couldn't read it. luckily i was only out $20. but the fact that he STOLE money means an ass whoopin if i were to see him face to face.

i have written a letter promising legal action if i don't recieve money or goods. i've also filed a dispute with the money-order company and paypal. still no word from him... though the paypal dispute resolution should get his attention quickly... seeing as how it will hurt his internet business if he doesn't fix it.
the legal action is for two seperate amounts for 500 dollars, one for stealing $105 dollars if goods aren't delivered, and the other for breaking a contract. i kept the amounts to 500 each to keep them in small claims court in the state of tennessee.
the letter was mailed by courier yesterday, and should arrive sometime this next week. it is signature required... by him... for it to be recieved. photo id required. this way he can't say he never recieved the legal notice.

ok, i emailed agent smith yesterday to inform him just briefly that he had 10 days to respond to me before the action would take place from paypal as well as myself...
i got a response
efrain will dig through and get me the last time agent smith logged on if i request it, but it was on christmas day. myself and nick have had several conversations about agent smith and we would always remark how he was never online. i sent nick a pm the instant i saw agent smith on december 25 with huge red letters. efrain could verify that as well, so agent smith was indeed here.
there are tons of fishy claims... let's name some:
1. shipping date discrepancies...
i asked for an expected delivery:

i know you can schedule a pickup... but they do not schedule 3 days in advance like that, and he wouldn't have his tracking numbers in the car if he had scheduled in advace for pickup.
discrepancies over price:

i asked him if 25 dollars added to the price would be enough:
i really do hate to be a jerk to some people, but i do feel justified. agent smith made bogus claims on the yahoo group of having a 2.2L lanos, which we all know is still a unicorn here in the states (no one has seen one... only rumors).
i'm not out to get him, i just want my money or stuff, and i know that nick feels the same (though he's only out 20 bucks). also, nick is just a few hours drive from san antonio, it shouldn't take you 15 days to walk that far, let alone carry a small box with a shifter.

for the amount of $500 over loss of my money/property, as well as $500 for
breach of contract (all the private messages you have sent to me have been
logged and stand as a contract). That puts you in a position to loose $1000
plus legal fees if I do not receive my parts that I ordered from you. On top
of that, Paypal with mar your Ebay store with a black mark as a non-shipping
seller and you will loose customers.

If you try to once again dodge me, I will tell you this as well. If i do not
get a response from you by January 10, 2006, I will be sending a courier to
your residence to hand deliver your summons for court. If that doesn't get
your attention I will press charges on the grounds of theft and then a
police officer will deliver to you a court summons, and possibly a warrant.
If you dodge that, you would be in contempt of court and would then be
placed on a fugitive listing. Based on the fact that I have all your
personal info like address, phone number, etc, I don't think it would be
hard for a bounty to be made upon you.

i just contacted the local police department regarding this. i encourage you
to not have someone deliver the papers, but rather send them certified mail
VIA the USPS.
oh, and im not worried about going to jail. i have several friends on the
force that will more than happily assist me with this matter, should it come
to that.

that. you might be referring to a signature verification of a delivery, but

ive got the tracking number at my apt. that is all the proof i have. youre
more than welcome to send your delivery guy to inspect the daewoo in my
parking lot. he will find its void of the parts you want. hell, he can tow
the whole bloody car, i have literally no more use for it.
i have no reason to lie to you, or attempt to cheat you out of a petty
ammount of money. if the post office lost the parts, i will replace them
free of charge. i do have hookups who can get me what i need.
however, i am not happy with your business practices. allow me to share some
of my years of experience at running a business with you...
when someone owes you money, you contact them first by phone. you ask them
politely 'hey, im not sure if you realize it, but you have an outstanding
debt with me and id like to get it resolved'.
if that doesnt work, you take it a step further and send them a letter
and/or email stating what the phone call said.
you do not send them ONE email threatening to sue them if they dont contact
you back.
paypal will not mar with ebay on this one, since ebay OWNS paypal and this
transaction had NOTHING to do with ebay. also, since you seem to think fin
addict and me are related, i guess it wouldnt hurt to point out that fin
addict has 100% positive feedback on ebay, due to ME selling for them. if i
went to court, that would help boost my character with the courts and show
them i dont rip people off.
also, im not affiliated with fin addict anymore, as the store owners owe ME
money. youre more than welcome to say all the nasty stuff you want about
them, but it in no way will come back on me. for the record, i dont own an
ebay store.
again, i apoligize since i know im being an ass, but had you sent a nice
email stating the point you had to make, i wouldnt have been an ass. i am
more than willing to get you the parts, but you have to give me time sir.
after i contact the post office monday (yes, i will go out of my bloody way
on my vacation to check on this), i will know what happened to the parts. if
they were delivered, i will start a claim process and email you the claim #
since you have made it clear the parts werent delivered.
if the parts were lost, i will start a claims process as well.
if, and only IF, the parts were delivered and the post office confirms this,
i will make sure that you have the parts you bought from me by the 10th. i
do have friends that can hook me up with daewoo stuff like that.
if they were lost, like i said, ill email you the claim # (and the tracking
#) and get back to you when its resolved. you cant honestly expect me to
replace parts that were lost in the mail.
ifyou do and sue me, you will most certainly be laughed out of court.

im sorry my vacation does not permit me to log onto daewootech every day,
but honestly man i have a life. i sold some other parts to people on that
forum (3 others to be exact) and you're the only one thats said he didnt get
his stuff.

paid for, one way or the other. you've seen the feedback on fin-addict on
ebay, 100%. im not a thief or con artist and i take great offence that you

couple things here...
1. your phone does not have a voicemail setup currently. i have my phone records which indicate 22 calls to you, all of which were un-answered covering 7 days.
2. Lanos2001, NICK DURRETE, did not recieve his stuff either
3. you told me you had an ebay store... i'll find the pm if need be.
4. your local law enforcement has no bearing on internet transactions regarding commerce. the fact of that is that it lies within the state's power as it is justified as an "interstate" transaction.
5. my brother is also an attorney. as far as the money goes, those are both the amounts legal by the state of tennessee in order to provide necesariy provisions to justify a court battle. i was assured by my lawyer as well as the TN state DA's office that this would hold up under circumstances if lead to be crimnal as well as civil.
6. i have had 6 packages, delivered from all parts of the country to my residence, all sent after december 18th, one of which was on upsp priority with expected delivery of 7-12 days.
look, the only reason i am an ass is because i don't have tons of money to throw around, and these were things that i was treating myself to. when i don't hear anything from you or get the stuff... i immediately worry. i did call, i'll mail you a copy of my phone bill clearly stating that i called the number you gave me on daewootech, 24 times totalling some 19.7 minutes (not that time matters).
you told myself and nick that you would get us our tracking numbers on the 17th of december, is it then a lie that you mailed them out that day too seeing as how you just emailed me stating it was on the 18th? these kind of discrepancies are what made me email you in the first place. i have emailed you before on your other email (the one provided at daewootech) and did not get a response there either. this is why i went to fin addict and got your email from there, which obviously worked.
i don't think i am in the wrong here. i am NOT the only member to have a claim against you as far as not recieving merchandise, so once again you've made a false claim. i only got in a fit because of the discrepancies, your timely vacation that left us in the dark, and the apparant lack of merchandise.
thank you for getting back to me. i hope you can see my point that from my perspective, things look fishy, and 100 bucks is a lot. i appologize for making you upset about this, but clearly i'm ahead of you there.
